Nature of the content
NeighborsMoans ([neighborsmoans.com]) is an audio-only platform. The Site
hosts sound recordings — moans, roleplay, spoken confidences — submitted by adult
members. The Site does not produce, create, or host any visual depiction of
actual or simulated sexually explicit conduct.
Exemption
The records-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75
apply to producers of *visual depictions* of actual sexually explicit conduct. As
NeighborsMoans publishes audio recordings only, and no visual depictions of
sexually explicit conduct, the operator of this Site is exempt from those
record-keeping requirements with respect to the content published here.
To the extent any content on the Site were to fall within the scope of
§ 2257 — including any imagery submitted with an audio recording — the operator
acts solely as a service provider under 17 U.S.C. § 512(c) and **47 U.S.C.
§ 230(c)**, and all such content is produced by third-party members who are
themselves the producers within the meaning of 28 C.F.R. § 75.1(c).
Age verification and consent of contributors
Every member who publishes on the Site must, at registration and at each upload:
- attest that they are 18 years of age or older (and above the age of
majority in their jurisdiction);
- attest that every person heard in the recording was 18 or older at the
time of recording and consented to the recording and to its publication;
- attest that they hold all rights necessary to publish the recording.
The operator retains the registration and submission records associated with each
published recording, including the attestations above, for **[DURÉE DE

legal basis, these records are kept.

Reporting
Any content believed to involve a minor, or a person who did not consent, must be
reported immediately to [abuse@neighborsmoans.com]. Such content is removed on
sight and reported to the competent authorities (Pharos in France, NCMEC
